Portfolio Recovery Associates are the slumlords of collection agencies. They keep calling me for a debt that is barred by the statute of limitations in my state. They keep telling me that if I don’t pay it that I will be going to jail. Isn’t that illegal?

These Portfolio Debt collectors must call me several times each day. They are relentless. I have told them to stop and each time they say, “We’ll call back”. The person they are calling for doesn’t liver here and never has.

Outfits like this buy unpaid claims from banks and other financial institutions for pennies in the dollar and then harass the purported debtors for payment. Usually they will settle for a fraction of the claim–they press those they call to get money from friends and family, from assets exempt in bankruptcy, or by borrowing from credit cards. I defended an elderly relative against one of these firms (could have been Recovery Associates, the name sounds familiar) against a claim originating with an AT&T cell phone account. I had settled the account with AT&T on the basis that I wouldn’t prosecute them for forging my client’s late husband’s signature on the contract and for mis-selling, and for refusal to close the account after she’d moved outside their service area, and they would write off their claim. But they sold it to one of these buyers of second-hand claims, who then tried to tell me they were not subject to the offsets, counterclaims or settlements. I sent them a registered letter at their head office and that finally put a stop to their harassment. (Bear in mind that once a debtor is represented by counsel a lawyer cannot, and a creditor should not, contact that debtor directly.) For consumers, the best defense to harassers is, I think, a Google Voice account (free). Change your existing numbers and then give out only your Google Voice number. Better than ordinary Caller ID.

Thanks all of you for the info. These buttholes from Portfolio Recovery Associates keep calling me from different telephone numbers across the US. like this one 1(757)961-3542. I don’t answer my Cell phone when a unusual number appears. I don’t know why these people keep calling me. It’s bugging me something aweful. I just left them three messages in their General Mailbox telling them to stop calling me but writing them is a better idea. Thanks for that. They have not sent me any correspondence. I really don’t know what they want. I think they have the wrong number. Thanks for making me feel more powerful, cuz I was really getting upset.

I’m another one who was being harassed by Portfolio Recovery Associates. They were after me for a debt nearly 20 years old. I filed an online complaint against them with the Federal Trade Commission. They seem to be leaving me alone now. I refuse to pick up the phone when they call, as does anyone else in my household. If they start up again, I’ll send them a cease-and-desist letter via Certified Mail, Return Receipt Requested. From what I’ve read elsewhere, Portfolio Recovery Associates has treated others much worse than they did me. I hope a way can soon be found to put this company out of business forever.

I just got a letter from the IRS indicating that Portfolio Recovery Associates issued a 1099C against me to the tune of a little over two grand in 2009. I can’t wait to get this one rolling. I’ve asked the Internal Revenue Service to contact them and ask them for some proof that I actually owe them money. Maybe I’ll get a reward for this. :)

One thing I notice by reading all of this is that everyone here agrees its okay not to pay your debts & its okay to play the stat game so you dont have to pay, thats WRONG if you owe you should pay because you agreed to terms you can read your not stupid. I think it is wrong to collect if the debt is NOT yours, if you are disabled, deceased. I belive that a brake should be given if your financially strapped work out a payment plan SOMETHING but dont just let your obligations sit there & expect for them to just vanish. there is no reason to disrespect anyone because they are financially strapped not everyone chooses to be broke as shit happens. I guess in a nut shell collections exist because someone has to do it & for those that are experiencing the harassing calls dont bitch about it – educate yourself & exercise your rights & document EVERYTHING! and preform ACTION because just bitching about it dosen’t create change action does!

Hot debate. What do you think? Thumb up 0 Thumb down 13

Hello I paid this company in full several months ago and I had to dispute the account so that it would be listed paid in full. Low and behold they updated but they did not remove the dispute comment. I have contacted them several times to update my info and they have not followed through on anything that they have promised. What can be done about this situation. Please advise.
